Privacy Policy
This is the Privacy Policy ("Privacy Policy") that explains how Gliding Knight Games ("Gliding Knight Games," "we," "us," or "our") will collect, protect, use, and share your personal information. The Privacy Policy is applicable to the videogame "Top Check" and any associated software, services we provide, files, patches, updates, upgrades, media, documentation, and material (collectively the "Game"). By accessing and using the Game, you consent to this Privacy Policy and authorize us to collect, store, access, use and transfer your information as described herein. Your acceptance of this Privacy Policy is required for your access and use of the Game.
The Game collects the information you provide when you use the Game and create a user account with Gliding Knight Games or an affiliate of Gliding Knight Games ("User Account"). While you use the Game and maintain a User Account, the Game may continue to collect information from you relating to your use of the Game or your User Account.
If you have correspondence with Gliding Knight Games, for example by communicating with us via email or social media, we may collect information contained in such correspondence.
We may automatically collect certain information when you use the Game. This information may contain device and usage information including but not limited to your IP address, approximate location, language preferences, platform-specific identifier, User Account specific identifier, information about how and when you use the Game, and other gameplay related or technical information.
In your course of using the Game's online features, our servers may automatically collect diagnostic, usage, and performance related data. Such data is recorded in log files and may contain personal information about you including but not limited to your IP address, your User Account info, your configured settings, date/time stamps associated with your Game related activity, and other information about your use of the Game.
The Game may collect and utilize your IP address as part of its multiplayer services, and such IP address may be able to approximate the location of your device. The Game does not collect any other information that could be used to precisely locate your device.
Gliding Knight Games may use the information we collect from you:
⦁ To verify your identity;
⦁ To correspond with you;
⦁ To improve the Game;
⦁ To link your Steam account with your User Account;
⦁ To administer your User Account;
⦁ To provide multiplayer services;
⦁ To perform skill based matchmaking;
⦁ To store configurations and settings (for example your deck lists);
⦁ To perform statistical analysis on an anonymized basis;
⦁ To enforce fair play and combat cheating;
⦁ To prevent or deter fraud or other harmful or illegal activities;
⦁ To protect and/or enforce our legal rights and interests;
⦁ To respond to a request from government authorities or law enforcement; and
⦁ For any other purpose authorized by you or permitted by applicable law.
Gliding Knight Games never shares any information it collects with third parties except as we expressly state below:
The Game uses select third-party services. These third-party services may automatically collect information during your use of the Game and as such the Game may share information about you and/or your use of the Game with the providers of these third-party services. Note that these third-party services have their own privacy policies regarding information handling. This Privacy Policy does not address the information handling practices of any third-parties, and we are not responsible for such practices. Below is a list of third-party services used by the Game and links to their privacy policies.

Gliding Knight Games may also disclose your personal information to its professional advisors (for example accountants, auditors, and lawyers), and any third party authorized by you.
When using the Game's multiplayer features, the Game may share some of your relevant personal information, for example your Display Name and Matchmaking Rating (MMR), with other users. You are encouraged to use a Display Name that does not contain sensitive information about you, like your real name or address.
Gliding Knight Games may use information you provide in connection to the Game to perform statistical analysis (on an anonymized basis). We may publish non-personally identifiable data relating to such statistical analysis in aggregate form.
Gliding Knight Games may also disclose information about you without your prior permission if we believe in good faith that disclosure is necessary:
⦁ To meet legal requirements, such as to comply with a judicial proceeding, court order, or other legal process;
⦁ To respond to a request from government authorities or law enforcement;
⦁ To combat or investigate fraud;
⦁ To enforce the terms of our End User License Agreement ("EULA"); or
⦁ To protect the rights, privacy, property, or safety of Gliding Knight Games or others.
In the event Gliding Knight Games or the Game is acquired, or Gliding Knight Games goes out of business, enters bankruptcy, undergoes reorganization, or merges with another company, information we have collected may be transferred to our successor or assign.
If you choose not to create and maintain a User Account or share personal information with Gliding Knight Games, then you may not be able to access or use some or all of the features of the Game. You can halt all collection of information by the Game by (1) deleting your User Account and (2) uninstalling the Game. If you would like to delete your User Account, you can send us a request using the contact details provided in Section 14. Note that before deleting your account, we may ask that you perform additional actions to verify your identity. The deletion of your User Account will also delete any information collected from you that was associated with your User Account (although we may still retain some residual information about you; see Section 8 for more details). If you would like to uninstall the Game, please use the standard uninstall process for your device. Uninstalling the Game WILL NOT delete any information collected from you that is associated with your User Account.
Children under the age of 13 are not permitted to use the Game, and we do not knowingly collect personal information from children under the age of 13.
Information we collect from you may be transferred to devices located in countries different from your country of residence. In such cases the transfer, storage, use, and processing of your information may be handled in accordance with laws that are different from the laws of your country of residence.
We may use personal information with automated decision-making procedures to identify users who are in breach of the Game's EULA and to prevent cheating. If an automated decision-making procedure determines a user is cheating or otherwise in breach of the Game's EULA, we may block that user's access to the Game and ban that user's User Account. In this situation the user will be notified of the ban when they try to log in to the User Account. If the user would like to contest this decision, they can contact Gliding Knight Games using the contact details provided in Section 14.
We may retain personal information about you for as long as you maintain a User Account, for as long as necessary for the purpose for which the personal information was collected, or for as long as needed for compliance with applicable law, whichever is longest. We are free to delete your User Account and/or User Provided Data at any time, for any reason or no reason. If your personal information is deleted, it may not be comprehensively removed from all our systems (for example because of backups, past aggregation into a non-personally identifiable form, etc.). Furthermore, if your personal information is changed or deleted, we may still retain some residual information about you in our files for purposes of recordkeeping, resolving disputes, enforcing our EULA, protecting against unlawful activities, or complying with applicable law.
Gliding Knight Games takes all reasonable measures to protect the personal information it collects from unauthorized access, use, alteration, or destruction. Please be aware that Gliding Knight Games uses devices managed by Microsoft Azure PlayFab to store and process information collected by the Game. Gliding Knight Games does have access to the information stored on such devices, and takes appropriate security measures to ensure that such information is not accessed, used, altered, or destroyed by any unauthorized third parties. Although we endeavor to provide reasonable security for information we process and maintain, no security system is 100% secure and human errors can occur, so it is possible an unauthorized third party could gain access to your personal information. If you have reason to believe your interactions with us are no longer secure, please contact us immediately using the contact details provided in Section 14.
Some countries, states, and jurisdictions give you the right to access, update, and remove your personal information. If you would like to make a related request, please email us using the contact details provided in Section 14, and provide any details relevant to the request in the email's body. Note that before processing such a request, we may ask that you perform additional actions to verify your identity. Such a request may also be subject to a reasonable processing fee where permitted by law. Please be aware that if we change or delete your personal information we may still retain some residual information about you; see Section 8 for more details.
If you are a California resident, then Section 1798.83 of the California Civil Code grants you the right to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. We do not share personal information with third parties for the direct marketing purposes of such third parties.
If you are a California resident under the age of 18, then you have the right to request the deletion of information you have uploaded pursuant of Professions Code Section 22581. To submit such a request, please follow the process outlined in Section 10. If you make such a request by email, include "California Privacy Rights" in the subject line.
If you are a resident of a country where the E.U. General Data Protection Regulation ("GDPR") applies, this section applies to you.
The personal information described in this Privacy Policy is personal data under the GDPR. Gliding Knight Games processes your personal data as described in this Privacy Policy, for the purposes outlined in this Privacy Policy. For details on how Gliding Knight Games handles the international transfer of your data, see Section 6. For details on our data retention policy, see Section 8.
Gliding Knight Games will only process your personal data if we have a valid legal basis for doing so. Most commonly, this legal basis will be among the following bases:
⦁ Consent. We may process your personal data if you have given us your consent to do so. You can revoke this consent at any time.
⦁ Performance of a Contract. We may process your personal data where needed to perform a contact with you (for example to provide the Game to you).
⦁ Legitimate Interests. We may process your personal data when such processing is reasonably necessary for the purposes of our legitimate interests (except where such interests would be overridden by your interests or your fundamental rights and freedoms which require protection of personal data).
Additional legal bases Gliding Knight Games may rely on to process your personal data include:
⦁ Vital Interests. We may process your personal data when such processing is necessary to protect your vital interest or the vital interest of another natural person (for example, if a threat were to be made on a person's life).
⦁ Public Interests. We may process your personal data when such processing is necessary for a task carried out in the public interest.
⦁ Legal Compliance. We may process your personal data when such processing is necessary to comply with a legal obligation.
Your rights in relation to your personal data under the GDPR may include (subject to any legal exceptions):
⦁ the right to be informed about our practices for handling personal data;
⦁ the right to access, rectify, and erase personal data;
⦁ the right to obtain a portable copy of your personal data;
⦁ the right to object to or restrict the processing of your personal data; and
⦁ where you have provided consent to the processing of your personal data, the right to withdraw such consent.
If applicable, you have the right to obtain human intervention to contest any decision made by an automated decision-making procedure. This can be done by contacting Gliding Knight Games using the contact details provided in Section 14. How we approach automated decision-making is described in more detail in Section 7.
You also have the right to file a complaint, although we would appreciate it if you gave us the opportunity to address any concerns you might have by making your complaint with us first before contacting a data protection regulator.
If you would like to access, update, or remove your personal data, please follow the process outlined in Section 10. For other requests related to your rights under the GDPR, please contact us using the contact details provided in Section 14.
From time to time we may modify this Privacy Policy. We will notify you of any changes to the Privacy Policy by updating our website with the new Privacy Policy. You are advised to check this Privacy Policy regularly for any changes, as using the Game following these changes means that you accept the revised Privacy Policy.
